Cotton Boll Pollinators LLC is licensed to sell bees by the NC Department of Agriculture & Consumer Services. Our packaged bees are accompanied by a certificate/notice of inspection by the origin state’s Dept. of Agriculture apiarist. Our customers will be given a copy of this certificate and will have the opportunity to visually observe that their purchased bees are healthy at the time of sale. It is important to note that it is not uncommon to see a couple of inches of dead bees on the bottom of packages, and this is not an indicator of poor bee health. We strongly suggest that customers install their bees into their new hives on the day (within 24 hours) of purchase. If the queen is found to be dead within 24 hours of picking up the purchased bee package (an occasional occurrence), the customer is responsible for contacting Cotton Boll Pollinators LLC via phone or email immediately, and the customer will be sent a one-time replacement queen at no cost. Notification of queen death beyond 24 hours after purchase will require the purchase of a new replacement queen at the listed price. The customer must pre-order all purchases and will need to select a preferred pickup date when making online purchases. Significant time and effort is required to ensure that all custom-pre-ordered products are prepared and ready for pick up on the customer-selected pickup dates, therefore all items must be pre-ordered and no additional sales will be allowed at pickup. All sales are pre-ordered for pickup only (no delivery or mail service), on predetermined customer-selected pickup dates from our NC location, and all sales are final. Refunds are not allowed under any situation beyond 14 days prior to the customer-selected pickup dates. Refunds requested before the 14-day period prior to the pickup date are only allowed if extreme, reasonably unforeseen, or extenuating circumstances occur, but will be accompanied by a $40 restocking fee or a change in pickup date for the original purchase.
All equipment and supplies are custom made or special ordered, and are only available for purchase to customers who pre-order and purchase packaged bees. Equipment and supplies are not kept on-hand indefinitely, and are only available through pre-ordering. All equipment and supplies must be picked up by the customer on the same day as the customer arrives to pickup their bee packages. Replacement equipment may be purchased if extenuating circumstances occur.
Bees sting perceived intruders in order to protect their hive or colony, and will sometimes exhibit aggressive behavior. Bee stings are to be expected by beekeepers, as this is a perfectly normal behavior in honey bees. It is advised that our customers consult with a physician prior to purchasing bees to determine if the customer (or any person/passenger accompanying the customer to pick up packaged bees) is allergic to, or is likely to have severe reactions to, bee stings, and/or if the customer or their passengers should require any medication for any possible allergies/reactions to bee stings. The customer (and any other persons/passengers) are responsible for bringing, and making easily accessible, any required medications or personal protective equipment they may need to avoid or treat bee stings. Prior to purchasing bees, the customer hereby formally and unequivocally agrees that Cotton Boll Pollinators LLC and their staff will not be held liable or responsible for damage or injury resulting from bee stings to the customer or any persons or passengers that may accompany the customer at the pickup location or during subsequent transport of bees, nor will Cotton Boll Pollinators LLC or their staff be held liable or responsible for any damages or injury that may result from side effects of the customer taking any necessary medication.
The customer is also responsible for providing adequate and suitable transportation for bees from the pickup site to the bee’s new location, to ensure bee health is maintained during transport to the bee’s destination and to prevent loss or damage to the customer, their passengers, the public, other vehicles, or others. Suitable transportation could include an open truck bed (weather permitting) or an open or enclosed trailer. Bees should be protected from hot temperatures, cold temperatures, severe winds, and especially rainfall. Bees can be transported in an open truck bed or open trailer, as long as protection from rain, heat, and wind is provided (secured cardboard, secured plywood, secured tarp, etc.). Bees should be kept cool (but not cold), well-ventilated, and protected from hot temperatures during transport. Ventilated enclosed trailers or ventilated truck-bed camper shells or camper bodies are usually ideal, depending on weather. Open truck beds or trailers may also be suitable as long as there is some sort of protection (cardboard, plywood, tarp, etc. secured by rachet straps or otherwise secure fasteners) from the aforementioned elements. Additionally, it’s important to note that it is not uncommon for a few bees to be found on the outside of the packages. It is NOT advised that customers make stops along their journey longer than a very few minutes, especially in hot temperatures, as this can cause bee death and/or agitation, or roaming of external bees that may appear on the outside of packages. It is NOT advised that customers transport bees inside their vehicle cabin, or otherwise within the same confines of a vehicle to be shared by customers or their passengers and the purchased bees. Sudden jarring or movement of the vehicle may cause packages to rupture, potentially releasing bees inside the cabin area shared by passengers. As previously mentioned, it’s important to note that it is not uncommon for a few bees to be found on the outside of the packages. These bees will generally remain on the outside of the package close to other bees, but warm temperatures inside the cab may agitate them or encourage them to move elsewhere within the cabin. Although customers are strongly advised not to transport bees inside their vehicle cabin or in any shared space between bees and passengers, if the customer insists on doing so, Cotton Boll Pollinators LLC staff will make every possible effort to remove any bees from the outside of packages, but there is no warranty or guarantee that all bees can or will be removed, and no guarantee that the packages will not rupture during transport, therefore the customer, themselves and alone, must load the bee packages into their own vehicle, and be prepared to cover them with a ventilated and secured blanket or tarp, or place them inside some sort of ventilated container within their vehicle, and keep the inside of the vehicle cabin at a constant, cool temperature. The customer hereby formally and unequivocally acknowledges and agrees that Cotton Boll Pollinators LLC and their staff does not endorse or recommend such transportation of bees within the confines of the vehicle cabin, and will be NOT be held liable or responsible for any damage or injury resulting from ruptured packages or additional bees that might appear on the outside of packages when loading bees into the vehicle or during transport. Additionally, packaged bees are fed sugar water solution or syrup that is applied to the packages externally via spray application and also within the package via a slow release container feeder. If customers insist on transporting bees inside their vehicle, they are strongly encouraged to cover their vehicle seats and floors (or any other component within the cabin) with non-permeable and non-absorbant fabric or plastic bedding, sheets, or tarps, to avoid and prevent any contact between the sugar syrup solution and any internal components of their vehicle, or damage to the customer’s vehicle resulting from such. This is also advised to prevent or avoid any punctures into seat cushions or any other components within the vehicle resulting from any sharp edges of the wood, screening, nails, or staples on the packages. If transporting bee packages in an open or enclosed truck bed or trailer, the customer is also responsible for properly securing packages (secure straps, containers, covers, etc.) during transport to prevent rupturing packages or release of bees. The customer hereby formally and unequivocally acknowledges and agrees that Cotton Boll Pollinators LLC and their staff will NOT be held liable or responsible for any damage or injury that occurs to the customer’s vehicle, the purchased bees and packages, other persons, passengers, or the subsequent release of bees into the environment or into the public, resulting from loading bee packages into the customer’s vehicle, improperly securing bee packages in the customer’s vehicle, transporting bee packages within the confines of the customer’s vehicle by the customer, or any other activity after the bees and packages are in the customer’s possession.
“Pickup dates are targeted dates depending upon weather or other unforeseen circumstances beyond our control. Delays occasionally occur due to weather or other logistical issues. Purchases will be available for pickup as close to the targeted and listed pickup dates as possible”
“In consideration of the risk of injury, illness, death, paralysis, damages, economical or emotional or psychological or physical loss, associated with beekeeping or interaction with bees, or presence on the property of COTTON BOLL Pollinators LLC, including travel to and from the property of COTTON BOLL Pollinators LLC, that may be suffered or incurred by the customer, or their accompanying minors, pets, or other persons, the customer knowingly and voluntarily agrees to enter into this waiver and release of liability and hereby waives any and all rights, claims, or causes of action of any kind resulting from or arising out of the customer’s participation in any activity with, and presence on the property of, COTTON BOLL Pollinators LLC or the company’s owners. The customer also knowingly and voluntarily agrees to enter this waiver and release of liability, and hereby waives any and all rights, claims, or causes of action of any kind, on behalf of the customer themself/themselves, the customer’s companion or accompanying persons and minors or pets, the customer’s heirs, executors, attorneys, personal representatives or agents, administrators, or assigns. The customer hereby releases and forever discharges COTTON BOLL Pollinators LLC, and their owners, affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns, for any and all liability associated with injury, illness, death, paralysis, damages, economical or emotional or psychological or physical loss that may occur to the customer, their accompanying persons, pets, or minors in the customer’s care, including travel to and from the property of COTTON BOLL Pollinators LLC or the company’s owners. ”
Customers that are purchasing bees or other products on behalf of other customers assume all responsibility/liability of and for the bees or products sold, the sale of such bees or products (including, but not limited to, payment, sales tax collection and payment), transportation of bees or other products to other additional/subsequent customers, and agree to assume all liability for such activities, and agree to convey these Terms & Conditions to their subsequent customers.
